About These Terms

These Website Terms of Use (“Terms”) apply to your access to and use of https://omexisdigital.com, including its pages, articles, forms, videos, downloads, features, and other content (collectively, the “Website”). The Website is operated by Omexis Digital (“Omexis Digital”, “we”, “us”, or “our”), a digital marketing agency.

In these Terms, “you” means any visitor or person using the Website. By accessing or using the Website, you confirm that you have read, understood, and agreed to these Terms. If you use the Website on behalf of an organisation, you confirm that you have authority to act for it. If you do not agree, you must stop using the Website.

Nothing in these Terms excludes or limits rights that cannot lawfully be excluded or limited under applicable law.

Omexis Digital provides digital marketing and technology-related services, including social media management, website development, SEO, branding, graphic design, content creation, video production, paid advertising, marketing strategy, analytics, automation, and AI-enabled solutions.

Descriptions of services on the Website are general information only. Availability, scope, pricing, timelines, deliverables, and commercial terms are confirmed separately in an accepted proposal, quotation, statement of work, order, or service agreement.

Permitted Use of the Website

You may access and use the Website for lawful, personal, informational, and legitimate business purposes. Subject to these Terms, you may view Website pages, share links to publicly available pages, contact us, and download materials that we expressly make available for download.

Permission to use the Website is limited, non-exclusive, revocable, and non-transferable. It does not transfer ownership of the Website or any content to you.

  • Impersonate another person, misrepresent an affiliation, submit another person’s information without authority, or interfere with another user’s access.

  • Use our name, logo, designs, case studies, portfolio, or content to suggest endorsement, partnership, authorisation, or affiliation without written permission.

We may restrict, block, or terminate access and take appropriate legal or technical action if we reasonably believe these Terms have been violated.

Enquiries Do Not Create a Client Contract

Submitting a form, requesting a consultation, sending a message, receiving general information, or discussing a project does not require Omexis Digital to accept work and does not create a client, partnership, agency, fiduciary, or advisory relationship.

A paid service engagement begins only when the parties accept a proposal, quotation, statement of work, order, or service agreement and any required deposit or advance payment is received. Those documents, not these Website Terms, govern the project.

We aim to keep Website information useful and current, but we do not guarantee that every statement is complete, accurate, error-free, or available at all times. To the maximum extent permitted by law, Omexis Digital and its affiliates, directors, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss; loss of profit, revenue, opportunity, goodwill, reputation, data, or anticipated savings; business interruption; device damage; or loss arising from reliance on Website content, inability to access the Website, malware, third-party services, external links, or unauthorised use of information.

Where liability arising solely from Website use cannot lawfully be excluded, our total aggregate liability will be limited to BHD 100 or the minimum remedy required by mandatory law, whichever is greater.

Nothing in these Terms excludes liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, wilful misconduct, or death or personal injury caused by negligence where applicable law prohibits limitation.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Omexis Digital and its affiliates, directors, employees, contractors, and representatives from third-party claims, losses, penalties, liabilities, and reasonable costs arising from your unlawful Website use, content you submit, infringement of another person’s rights, misuse of Website content, or material breach of these Terms.

This clause does not require you to indemnify Omexis Digital to the extent a claim results from our own breach, gross negligence, or wilful misconduct.

Suspension and Termination of Access

We may suspend, restrict, or permanently terminate your access to all or part of the Website if we reasonably believe you have violated these Terms, created a security or legal risk, interfered with the Website, infringed rights, or acted unlawfully. We may preserve evidence and cooperate with authorities or rights holders where legally permitted or required.

Provisions concerning intellectual property, submitted content, disclaimers, liability, indemnification, governing law, and other clauses intended by nature to continue will survive termination of access.

General Provisions

If any provision is found invalid or unenforceable, it will be limited or removed only to the minimum necessary, and the remaining provisions will continue. Our failure or delay in enforcing a right is not a waiver. These Terms do not create employment, partnership, joint venture, agency, fiduciary duty, or authority to bind Omexis Digital.

We may assign these Terms to an affiliate or successor as part of a restructuring, merger, financing, transfer, or sale. You may not assign rights under these Terms without our written consent.
